INFORMATION ON THE PROCESSING OF PERSONAL DATA

of users consulting the www.colmic.it website

(pursuant to Art. 13 of EU Regulation 2016/679)

 

Pursuant to EU Regulation 2016/679 (hereinafter the Regulation), this page describes how the personal data of users consulting the website www.colmic.it is processed.

This information does not concern other sites, pages or online services that can be reached through hyperlinks that may be published on the site but which refer to resources outside the domain of Colmic Italia S.p.a.,  a single shareholder company.

 

This information notice is addressed to natural persons who access the website www.colmic.it and perform at least one of the following operations:

  • - Visit the pages of the aforementioned site;
  • - Request subscription to the newsletter service via the form on some pages;
  • - Send messages via the form on the contact page or directly to the email addresses published on the site.

The information given here is issued by the owner of the aforementioned site and does not concern any linked third-party sites.

Data of a personal nature provided may be disclosed to duly appointed recipients who will process the data as data processors and/or as persons in charge of processing in order to fulfil contracts or related purposes.

In this role, COLMIC ITALIA S.p.A., a single shareholder company, determines the purposes and means of the processing of the personal data provided. In the rest of the document, it will be referred to as the Data Controller. The full list of data processors and persons in charge of processing personal data, and the appointment of the Data Protection Officer can be obtained by sending a request to info@colmic.it

PURPOSE OF TREATMENT and LEGAL BASIS

The provision of personal data has contractual or pre-contractual requirements or the fulfilment of legal obligations to which the Data Controller is subject as its legal basis for processing. For this reason, any refusal to process, or the failure, inexact or partial provision of data could result in the impossibility of proper provision of the service or the impossibility for the Data Controller to respond to requests for information sent by the data subject.

The data provided during browsing will be processed to ensure the functionality of the site and to carry out statistical evaluations of the visits received (see also the BROWSING DATA section). In this case, the legal basis is the legitimate interest of the Data Controller in obtaining anonymous statistics on visits to one of its business channels.

When a visitor sends a message from the contact page or directly to our email addresses, the data provided will be processed exclusively for the purpose of responding to the enquiry sent. If the visitor decides to subscribe to the newsletter service, the data sent will be used by the Data Controller to keep the visitor updated on events promoted by Colmic Italia S.p.a., a single shareholder company. In the latter two cases, the legal basis is the need to carry out processing for the performance of a contract or pre-contractual measures, albeit a free service.

RECIPIENTS WHO MAY RECEIVE DATA COMMUNICATION

The data provided by subscribing to the newsletter or via the contact form will only be processed by the authorised in-house staff of the Data Controller. For data relating to mere visits to the site pages, please refer to the browsing data section.

DATA TRANSFER

The data provided by subscribing to the newsletter or via the contact form will be processed on the premises of the Data Controller and thus exclusively on Italian territory. Part of the browsing data may also be partially processed on the systems of the provider Google LLC, which in any case claims to use systems that offer guarantees of adequacy with regard to EU Regulation 679/2016.

WITHDRAWAL OF CONSENT

The data subject may revoke his or her consent to receive communications of a union and/or welfare nature immediately by sending a request to info@colmic.it

DATA RETENTION PERIOD

The personal data processed is either collected as provided directly by the data subject or automatically.

Data provided directly by the data subject is all personal data that is provided to the Data Controller directly by the data subject by any means.

The data collected automatically is browsing data. Although this data is not collected with a view to being associated with the identity of the user, it may indirectly enable the user to be identified through processing and association with data collected by the Data Controller.

Following the sending of newsletters, the platform used makes it possible to detect the opening of a message and the clicks made within the newsletter itself, together with details of the IP and browser/device used. The collection of this data is essential for the operation of the implicit renewal systems (see Method of Processing) and an integral part of the operation of the sending platform. The data provided via the Work With Us page will be stored for as long as necessary for recruitment purposes and in any case no longer than 3 years. The data provided via the Contact section will be kept for the time necessary to process the last request for information and for a further period to respond to any subsequent requests, but in any case no longer than 3 years.

RIGHTS OF THE DATA SUBJECT (person whose data is collected)

The data subject has the following rights:

Right of access: Pursuant to Art. 15, the data subject has the right to obtain confirmation that personal data concerning him or her is being processed and, where appropriate, to obtain a copy of that data. He or she also has the right to obtain access to the personal data concerning him or her and to further information such as the purpose of the processing, the categories of recipients, the period of data retention and the rights that can be exercised. 

Right of rectification: Pursuant to Article 16, the data subject has the right to have inaccurate personal data concerning him or her rectified or supplemented.

 - Right to erasure: the data subject has the right to obtain the erasure of personal data concerning him or her without undue delay if one of the reasons provided for in Art. 17 applies.

Right to restriction of processing: the data subject has the right to obtain restriction of processing in the cases provided for in Article 18 of Regulation 2016/679.

 - Right to data portability: the data subject has the right to receive personal data concerning him or her in a structured, commonly used and machine-readable format and has the right to transmit such data to another data controller without hindrance, in accordance with Article 20 of Regulation 2016/679.

- Right to object to processing and to lodge a complaint: the data subject has the right to object to the processing of personal data concerning him or her in accordance with Article 21 of Regulation 2016/679. If the data subject considers that the processing of personal data relating to him or her carried out through this site is in breach of the provisions of the Regulation, he or she has the right to lodge a complaint with the competent supervisory authority, the Italian Data Protection Authority, as provided for by Art. 77 of the Regulation, or to take appropriate legal action (Art. 79 of the Regulation).

Requests referred to in the preceding points must be addressed to the Data Controller in writing. The Data Controller shall provide timely responses to requests to exercise the rights of data subjects within the time limits established by the applicable legislation.

Any explanations or requests for clarification may be addressed to the Data Controller in writing.

 

NATURE OF DATA PROVISION

The data in the newsletter subscription and contact form is mandatory.

For other data, please refer to the next section.

BROWSING DATA

This category of data includes the IP addresses or domain names of the computers used by users connecting to the site, the URI (Uniform Resource Identifier) notation addresses of the resources requested, and other parameters connected with the HTTP protocol and relating to the user's operating system and computer environment. This data is used for the sole purpose of obtaining anonymous statistical information on the use of the site and to check its correct functioning, and is deleted immediately after processing. The data could be used to ascertain liability in the event of any computer crimes against the site: except in this case, web contact data is not currently stored for more than one month.

Cookies

Cookies are used by websites to recognise users during a visit to the site.

As indicated by the provisions of the Italian Data Protection Authority, they are small alphanumeric text files

which the sites visited by the user send to the user's browser, where they are stored and sent back to the same sites the next time the same user visits.

The Data Controller's site uses cookies mainly to enable browsing on the site and the use of related services. For this reason, these cookies do not require the user's consent, unlike third-party cookies.

We use the services offered by Google and Google Analytics to collect, aggregate and analyse data in order to better understand how our visitors use the site. These cookies are used by the Data Controller directly or through a contracted vendor to collect anonymous and aggregate information and have a limited duration. For example, the information collected is used to monitor and analyse the use of the site, to improve its functionality and to choose the content and graphics more accurately in order to meet the needs of visitors. The Google Analytics privacy policy can be found at http://www.google.com/intl/it_ALL/analytics/learn/privacy.html However, if you would prefer these specific cookies not to be activated for whatever reason, Google provides a free extension that can be installed on the main browsers (https://tools.google.com/dlpage/gaoptout).

We would also like to remind you that, by configuring his or her browser, the user can disable the operation of cookies at any time or be informed when he or she receives a cookie and refuse to consent to its being sent. Non-acceptance of such cookies may jeopardise

some functionalities of the site.

DATA RECIPIENTS

Data of a personal nature supplied may be communicated to duly appointed recipients who will process the data in their capacity as data processors and/or persons in charge of processing.

The Data Controller does not disclose any of the data subjects' information to third parties without their consent, except where required by law. The dissemination of processed personal data is in any case excluded.   

The data provided by subscribing to the newsletter will only be processed by the authorised in-house staff of the Data Controller.

The personal data collected is also processed by the authorised staff of the Association, who act on the basis of specific instructions given regarding the purposes and methods of processing. METHOD OF PROCESSING

Personal data is processed by automated tools for as long as is strictly necessary to achieve the purposes for which it was collected, providing for an annual check of the stored data in any case in order to delete that considered obsolete, unless the law provides for archiving obligations. Data processing is normally carried out on the Data Controller's premises by employees authorised to do so or external collaborators duly designated as data processors. The full list of data processors and persons in charge of processing personal data can be obtained by sending a request to info@colmic.it Specific security measures are observed to prevent loss of data, unlawful or incorrect use and unauthorised access. The subscription and related processing are deemed valid until the user unsubscribes using the link present in each email.

The personal data provided by users who request information material to be sent to them is used solely for the purpose of performing the service requested and is communicated to third parties only if this is necessary for that purpose.

UPDATES AND MODIFICATIONS

The Data Controller reserves the right to amend, supplement or update this Policy from time to time in accordance with applicable legislation or measures adopted by the Italian Data Protection Authority.

The aforementioned changes or additions will be brought to the attention of those concerned. We invite users to review the Privacy Policy on a regular basis in order to check the updated information and decide whether or not to continue using the services offered.
